Plugin Terms of Use

Agreement to Terms

By accessing and using any public or paid plugin ("software", "product") produced or maintained by kixmc, you confirm you have read, understood, and agreed to be bound by all of these Terms of Use for the full duration of time you use the plugin(s).

Section 1

kixmc reserves the right, in sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason.

1. You will be subject to, and will be deemed to have accepted the changes in any revised Terms of Use by your continued use of the product after the date such revised Terms of Use are posted.

   1. It is your responsibility to periodically review these Terms of Use to stay informed of updates. We may provide notice of changes, but are not required to.

Section 2

Unless otherwise indicated, all software produced by kixmc is kixmc's proprietary property. This includes all source code / bytecode of the software and any official texts/documentation relating to the product.

1. The content and features provided within all software by kixmc are “AS IS” for use on a single production game server OR network of servers under common ownership/control.

2. No part of any software's source code / bytecode may be copied, modified in any way, deobfuscated, changed, reproduced, aggregated, republished, uploaded, publicly or privately displayed, encoded, transmitted, distributed, sold, licensed, or otherwise used for any purpose without kixmc's prior written permission.

   1. This term (2.2) does not apply to any provided APIs

Section 3

This section (3) only applies to kixmc's paid ("premium") products.

Upon purchasing a premium plugin, you are granted a non-exclusive, non-transferable, revocable license to run the plugin on a single production game server OR network of servers under common ownership/control.

Refunds are permitted under some circumstances, and should be requested instead of filing a chargeback or opening a case against the charge.

1. By purchasing any of kixmc's paid ("premium") software, you agree that all sales are final except as required by applicable law or as stated in this policy.

   1. Refunds will be only issued in the case there is context and reasoning deemed valid by the support team.

   2. Depending on the context, you may only be eligible for a partial refund instead of a whole refund.

Section 4

Depending on the software, anonymized data about your server & your use of the software may be collected to help improve the product in future releases.

1. Data collected includes but is not limited to: whether or not you use particular plugin features, server version, java version, server region, and alike.

   1. Data that could identify you, anybody or your server is never collected.

   2. All data gets sent and stored anonymously.

   3. You can opt out of metric collection in the bStats configuration file, which is generated along with any products if applicable. If there is no bStats folder, no metrics are collected.

Section 5

While help & support with issues regarding kixmc's products is provided by community members and kixmc, there is no guarantees.

1. Plugins are generally provided "AS IS". If you have trouble, you are expected to first review available wiki / docs and try and problem solve on your own. Kix's support Discord is provided so plugin users can chat and help one another out and report issues. kixmc, the support team, or kix's Discord community members have no obligation to give you support, and can deny you support for any reason they deem appropriate, such as unprofessionalism or general misconduct.

   1. If you are requesting support with one of kixmc's paid/premium resources, you will be required to show proof of ownership of a license to use the software.

Section 6

kixmc reserves the right to change, modify, or remove the contents of any provided products at any time or for any reason at kixmc's sole discretion without notice.

1. kixmc has no obligation to update any official information and or documentations on any of the products provided, and will not be liable for the lack of any particular documentation.

   1. kixmc reserves the right to modify or discontinue any products provided without notice at any time.

   2. kixmc will not be liable to you or any third party for any modification, price change, or suspension of any products provided.
